This document contains the terms and conditions of use and legal information (hereinafter, the “Terms and Conditions”) applicable to the access and use of the services offered by Alternativo Perú SAC, with RUC No. 20602341608 (hereinafter, “Peru Well Served”).
Peru Well Served is a company that offers services focused on tourist experiences that motivate the discovery and promotion of Peruvian gastronomy, those that are developed tailored to the requirements of each of its clients (hereinafter, the “Services”) .
Any person who hires the Services assumes the role of Client (collectively, the “Clients”), committing themselves to the observance and strict compliance with the provisions included in these Terms and Conditions.
Peru Well Served complies with communicating to each Client that in case they do not agree with the content of the Terms and Conditions, they refrain from accessing and / or contracting the Services.
Therefore, when contracting the Services, the Client expressly declares to have read the Terms and Conditions and, therefore, to know and understand them perfectly, accepting them in all their extremes.
Notwithstanding all of the aforementioned, in order to be a Peru Well Served Client, it is essential that a person complies with:
Be of age.
Provide only truthful information.
Accept these Terms and Conditions.
The Client guarantees in advance that all the data provided to Peru Well Served before, during and after the provision of the Services are true, exact and complete.
Of the Contracting of Services
In order for the Client to contract the Services, they must make a request through the following Peru Well Served channels:

Once Peru Well Served receives the request, it will coordinate a call with the Client within the following two (2) business days in order to collect information according to a Brief focused on the Services.
After collecting the information from the Brief, Peru Well Served will prepare a proposal for the Services, which will include an itinerary designed according to the Client’s requirements (hereinafter, the “Itinerary”) and a budget (hereinafter, the “Quote ”).
The Client accepts and declares that he may request Peru Well Served to make changes to the Itinerary and the Quote only once.
In case the Client requests additional modifications, Peru Well Served will have the right to request a deposit of USD 200.00 (Two Hundred and 00/100 American Dollars), an amount that will be used as (1) credit in favor of the Client in case the contracting of services; or, (2) in case the Client does not contract the Services after requesting the additional modifications, as consideration in favor of Peru Well Served for the planning and development of the Itinerary and the Quote.
The Client must confirm by email the contracting of the Services no later than seven (7) calendar days after having received the Itinerary and the Quote, otherwise Peru Well Served will proceed to cancel the Services proposal.
From Suppliers
The Client accepts and declares to know that Peru Well Served may outsource and / or subcontract services offered by other companies (hereinafter, the “Suppliers”) in order to comply with the Itinerary involved in the provision of the Services.
The Providers involved in the provision of the Services may be, but not limited to, the following:
Airlines
Hotels
Land Transport Companies
Tour Operators
Restaurants
Chefs
Tour guides
Of the Quotation of the Services
The Quote contains an estimate of the price of each of the activities involved in the Itinerary.
Although it is true, Peru Well Served will make its best efforts so that there are no variations in the Quote, it will not be responsible for changes that Suppliers may make regarding tickets, vouchers, tickets and, in general, any rate that is under its sphere of control during the provision of the Services. In the event of the latter happening, Peru Well Served will promptly notify the Client via email.
In order that the Quote is not subject to variations, the Client accepts and declares to know that they must comply with the following confirmation deadlines for the trips involved in the provision of the Services:
If the travel date is more than eight (8) weeks away, the Client must confirm his reservation within a period of seven (7) calendar days from the day on which Peru Well Served sent him the Services proposal to the Client.
If the travel date is less than eight (8) weeks away, the Client must confirm his reservation within a period of four (4) calendar days from the day on which Peru Well Served sent him the Services proposal to the Client.
The Quote does not include additional payments for tips, excess baggage or any other activity or service not specified in the Itinerary.
Reservation and Payment of Services
Once the contracting of the Services has been confirmed, Peru Well Served will issue the Client a ticket or electronic invoice for the total amount to be paid for the Services (in advance, the “Price”)
If the date of the trip is more than eight (8) weeks away, the Client will be asked to make a deposit with 50% of the Price, an amount that will be used to confirm the trip reservations and secure the corresponding spaces. The other 50% of the Price may be paid by the Client with an anticipation of no less than forty-five (45) calendar days before their arrival in Peru.
If the date of the trip is less than eight (8) weeks away, the Client will be asked to make a deposit with 100% of the Price, an amount that will be used to confirm the trip reservations and secure the corresponding spaces.
Once the payment of the Price has been made in any of the situations described above, the Client must send Peru Well Served the respective proof that confirms the operation, at which time Peru Well Served will proceed to manage the contracting of the Suppliers involved in the provision. of the Services.
Until receiving the confirmation in writing from the Suppliers, Peru Well Served will not be able to fully confirm some details of the Itinerary, those referred to but not limited to flight schedules, land transport, maritime transport, hotel accommodation, restaurant reservations, gastronomic experiences , tourist incursions, etc.
Once the confirmation from the Suppliers has been received, Peru Well Served will proceed to confirm the rest of the details contemplated in the Services proposal.
The Client accepts and declares to know that in case he does not make the payment of the Price according to the specifications contained in the literals a) and b) of this section, Peru Well Served will have the right to cancel the reservations immediately and retain any amount that the Client has deposited.
It is stated that the payment of the Price will only be made in Nuevos Soles or US Dollars.
The Client accepts and declares to know that the Services that Peru Well Served offers are sold as a package, so it may not demand that any of the activities included in the Itinerary be quoted independently.
In case any of the activities involved in the provision of the Services is not available, the Client accepts and agrees that Peru Well Served can propose other similar alternatives.
Peru Well Served will only consider the payment of the valid Price when the deposits made by the Client are made in the following bank account:

Likewise, Peru Well Served will accept that the Client pay the Price using credit cards, as long as they are VISA, American Express, MasterCard and / or Diners Club.
About Changes and Modifications in the Services
After guaranteeing the reservation of the trip with the deposit of at least 50% of the total Price, any modification that the Client requires to make on the Itinerary will be subject to the charge of USD 50.00 (Fifty and 00/100 American Dollars), an amount that It will be used to cover administrative expenses of Peru Well Served.
The Client accepts and declares that Peru Well Served will not be responsible for the payment of the additional fees that the Suppliers may charge as a result of the modifications described in the previous paragraph, for which they acknowledge being solely responsible for the payment of the aforementioned rates and, in general, of any variation in the Quote that occurs after Peru Well Served has turned the ballot or electronic invoice for the total amount of the Services.
Peru Well Served will issue the Client an additional electronic ticket or invoice for the total amount of the additional fees and administrative expenses that are generated as a result of the modifications that the latter requires to make on the Itinerary.
Likewise, the Client declares and accepts that it will be solely responsible for assuming the expenses generated by changes caused by reasons of force majeure, social and / or political disturbances, strikes at airports, stoppages on land routes and, in general, for any extraordinary phenomenon to the provision of the Services.
Peru Well Served contracts Suppliers to comply with the Itinerary involved in the provision of the Services, therefore, it will notify the Client, as soon as appropriate and practical, about any type of changes that may occur in the aforementioned Itinerary, be these minor changes or significant changes.
Without prejudice to everything mentioned in this section, if the Client makes modifications to the Itinerary on their own, Peru Well Served will not assume any type of responsibility regarding the additional costs that may occur as a result of it.
Of the Cancellation of the Services
In case the Client wishes to cancel the Services and, consequently, the reservations of the trip and the corresponding spaces, the Client must notify Peru Well Served immediately through an email communication in that sense addressed to: contact@peruwellserved.com
In the case the Client sends the communication described in the previous paragraph, Peru Well Served will evaluate the moment in which the cancellation notice was notified and will return the following amounts:
In case the Client cancels the Services forty-five (45) calendar days or less before their arrival in Peru, Peru Well Served will not refund any part of the amount deposited for the payment of the Price.
In case the Client cancels the Services with between forty-six (46) and seventy-five (75) calendar days remaining for his arrival in Peru, Peru Well Served will reimburse him 50% of the amount deposited for the payment of the Price.
In case the Client cancels the Services with between seventy-six (76) and one hundred twenty (120) calendar days remaining for his arrival in Peru, Peru Well Served will reimburse him 60% of the amount deposited for the payment of the Price.
In case the Client cancels the Services with one hundred twenty-one (121) calendar days or more remaining for their arrival in Peru, Peru Well Served will reimburse 70% of the amount deposited for the payment of the Price.
The Client accepts and declares to know that the reimbursements mentioned in the previous sections are conditioned to the internal policies of each of the Suppliers, that is, without prejudice to Peru Well Served making its maximum efforts to comply with the reimbursement percentages aforementioned, the latter will not be liable to the Client for the amounts of the Price that the Suppliers do not want to reimburse in accordance with their own return policies.
Likewise, the Client accepts and declares that he must bear any type of expenses in which Peru Well Served must incur to reimburse him a part of the deposit for the payment of the Price.
Under no circumstances will Peru Well Served be obliged to reimburse the Client for any amount related to the activities or services that were not used voluntarily or for reasons attributable to it, such as a delay for example.
Regarding the trips involved in the provision of the Services, the Client accepts and declares to know that national and international air tickets are not refundable, so in case they request a modification or change of date in the respective air ticket, this will be the Only responsible for paying the penalties applied for such purposes by the airline in charge of the aforementioned service.
Peru Well Served reserves the right to cancel reservations involved in the Services in circumstances in which they are forced to do so due to reasons that are outside their sphere of control. In such circumstances, Peru Well Served will use its best efforts to find and offer the Client other reservations at the same Price. However, if that is not possible or if the Client does not wish to accept the alternatives proposed by Peru Well Served, the latter will refund the largest amount that it is possible to recover from the providers, considering that there will be expenses that may not be reimbursed, such as tickets air, tickets, trains, among others.
The previous paragraph refers to all those situations that could significantly alter the Itinerary involved in the provision of the Services, which includes but is not limited to an unforeseen change in the tickets made by the contracted airlines, the impossibility of visiting a tourist destination due to weather issues and the cancellation of the gastronomic experiences by the contracted restaurants.
Details of the Services
Peru Well Served will answer the Client’s doubts, queries and calls at any time during the provision of the Services, for which the latter must contact the emergency telephones that will be communicated with the delivery of the travel documentation.
The Client accepts and declares to know that the check-in in the hotels generally begins around 3:00 p.m. and the “check-out” around 10:00 a.m. The Services do not include early check-in or late check-out, so these are the responsibility of the Client.
In everything related to air tickets, trains and boats, payment of 100% in advance is required in order to issue the respective tickets and / or manage the corresponding reservations. The rates will be subject to modifications until the final issuance of the tickets.
The Client accepts and declares to know that some air flight rates are only valid for Peruvians who have a valid Peruvian passport.
Peru Well Served will need to have the Client’s passports to be able to carry out all the procedures involved in the provision of the Services, so the latter agrees to deliver their passports immediately after Peru Well Served requests them.
The Services include a host who will accompany the Client throughout their stay in Peru, attending to their requirements and needs.
The Client accepts and declares to know that the host will be authorized to immediately suspend the functions under its charge when:
The Client tries to involve the host in any situation that goes against the laws of the Republic of Peru, such as the acquisition of illegal substances, human trafficking, sex tourism, fraud, theft and, in general, any type of illegal activities. . The host will immediately report to the competent authorities when any of the aforementioned assumptions are met.
The Client attempts against the physical and mental integrity of the host, or these are threatened by the Client.
The Client represents a danger to the host and to any third party, in which case the host will also immediately report to the competent authorities.
Tips for the Host are not included in the Price, so they are voluntary for the Client.
The Client accepts and declares to know that the Host does not fulfill functions nor will he perform as a tour guide, security personnel, assistant and / or chef. Consequently, the Client is obliged only to resort to the Host so that it can meet the requirements and ordinary needs that it may have throughout its stay.
Of Gastronomic Experiences
During the provision of the Services, Peru Well Served makes sure to take its Clients to restaurants where the services are of the best quality, both in terms of attention and care and food preparation.
Peru Well Served is not responsible for any reactions or discomforts that the Client may suffer as a result of certain allergies, sensitivities or previous conditions.
The Client is obliged to report all the information that could prevent the reactions and discomforts indicated in the previous paragraph from occurring, which is why Peru Well Served will deliver a Waiver so that they have the opportunity to provide all the information that ensures that the gastronomic experiences of the Itinerary can be developed in the safest way possible.
The Client guarantees that all the data provided to Peru Well Served in the Waiver will be true, exact and complete. Likewise, if there is a change in the data provided, the Client undertakes to immediately carry out the corresponding update.
In case the Client provides false, inaccurate or incomplete information in the Waiver, Peru Well Served will not be responsible under any circumstances.
Finally, the Client accepts and declares to know that there are restaurants that must be reserved well in advance, for which they undertake to comply with an advance deposit if necessary to ensure the respective reservations and comply with the Itinerary.
Travel Insurance
The Client is solely responsible for the custody of their luggage and documentation, so Peru Well Served will not be responsible for the loss, theft and / or deterioration of the Client’s luggage and / or documentation.
For the aforementioned, Peru Well Served recommends that the Client take out travel insurance during the provision of the Services.
In case the Client does not have international health insurance, Peru Well Served recommends that one be contracted before the provision of the Services.
If the Client requests it, Peru Well Served will be able to assist them in hiring an insurance service that meets their needs.
Obligations of the Client
The Client undertakes to have a valid passport with at least six (6) months of validity counted from the date of return from the trip and with at least three (3) blank pages to allow visas, entry and exit stamps , etc.
The Client is obliged to be up to date with their visas, health documents, vaccinations and insurance necessary to be able to enter Peru.
Peru Well Served will not be responsible under any circumstances for the failures in which the Client may incur during the obtaining or processing of the aforementioned documents. Likewise, it is not responsible in case the Client does not comply with any other requirement to enter Peru in accordance with current regulations.
The Client accepts and declares to know that Peru Well Served is not under the obligation to inform him of the necessary requirements to enter Peru, since the Services do not have the nature or include immigration advice.
The Client undertakes to carry with him at all times the documentation provided by Peru Well Served and that is essential for the Services to be provided in an ideal manner. The documentation includes but is not limited to personal documents, accommodation and service vouchers, entrance tickets, air tickets, train tickets or other means of transport and, in general, any document essential for the correct execution of the Services.
The Client undertakes and is solely responsible for arriving on time at the departure places indicated in the Itinerary, for which Peru Well Served will not be responsible for any loss, damage or event caused as a result of failing to comply with such obligation.
Responsibility of the Client and Peru Well Served
The Client declares and accepts that it is responsible for all types of losses and damages, including but not limited to any consequential damage or loss of profit, that may be caused during the provision of the Services to other Clients, to Suppliers and, in general, to any third party.
Consequently, the Client will hold Peru Well Served, its directors, employees and shareholders harmless with respect to any lawsuit, claim, complaint, process, judicial or extrajudicial measure within or outside the process (including, but not limited to precautionary measures) or investigation before any jurisdiction, be it civil, criminal, administrative, regulatory or arbitral, that may be filed by any Administrative Authority or by any person in case the Client is in one of the situations described in the previous paragraph.
The Client is also obliged to assume the costs and expenses that the respective lawsuits, claims, complaints, processes, measures and investigations require, including professional attorneys’ fees.
Consequently, the Client must directly bear the costs, expenses and damages described, or; if this is the case, immediately reimburse the amounts assumed by Peru Well Served for such concepts.
Likewise, within the scope of the Services, the Clients declare to know and accept that Peru Well Served is not dedicated to providing any of the services provided by the Suppliers, so the Client waives all kinds of claims against Peru Well Served, its directors, employees and shareholders, regarding the services that Suppliers provide as part of the Itinerary.
In accordance with Article No. 1328 of the Peruvian Civil Code, the aforementioned waiver is not applicable in the event of fraud, inexcusable fault or gross negligence.
Without prejudice to all the aforementioned, the Client declares and accepts that Peru Well Served will not be responsible under any circumstances for the damages and losses that the Client may suffer in case he deliberately decides to carry out any activity that is not included in the Itinerary or in If it is voluntarily placed in risk situations that are not included within the Services or its ordinary scope.
In addition, the Client accepts and declares that Peru Well Served is not obliged to repair any type of damage when it has been produced as a consequence of a fortuitous event or force majeure, the determining fact of a third party or the recklessness of the person suffering from the hurt. Likewise, the Client accepts and declares to know that Peru Well Served will not be responsible for a late, defective or partial non-performance of the Services as a consequence of a fortuitous event or force majeure.
Privacy and Personal Data
Peru Well Served undertakes to treat the personal data provided by the Client confidentially and exclusively for the purpose of offering the Services, with all the legal and security guarantees imposed by Law No. 29733, Personal Data Protection Law and its respective Regulations.
In case the User wishes to exercise the rights contemplated in the Law on Protection of Personal Data and its respective Regulations, they must send an email to contact@peruwellserved.com .
Peru Well Served undertakes not to transfer, sell or share the data to third parties without the prior, express and written consent of the Client.
Peru Well Served adopts the security levels required by the Personal Data Protection Law and its Regulations. However, it does not assume any responsibility for damages derived from alterations that third parties may cause in their respective Personal Data Bank. Peru Well Served may disclose personal information if required by court order.
Integrity of the Terms and Conditions
These Terms and Conditions replace all previous or contemporary communications and / or agreements (oral, written or electronic) between the Client and Peru Well Served. If any provision of these Terms and Conditions is invalid, the invalidity will be applied to the minimum extent necessary for the other stipulations to continue to be enforceable. If Peru Well Served or the Client do not exercise the rights and powers that correspond to them in accordance with the Terms and Conditions, it will not be considered as a waiver of the continuation of the same and of the other rights and powers established herein.
Assignment
The Terms and Conditions are personal and in no case can they be assigned or transferred to third parties without the prior written consent of Peru Well Served.
Peru Well Served may assign, transfer or delegate any of its rights and obligations without the prior consent of the Client, for which the Clients accept and authorize in advance a possible assignment of the contractual position of Peru Well Served in favor of any third party.
Applicable Law and Jurisdiction
These Terms and Conditions will be governed by the Laws applicable in the Republic of Peru. Any controversy derived from the Terms and Conditions, their existence, validity, interpretation, scope or compliance will be submitted to the jurisdiction of the courts and judges of Cercado de Lima.
