INTRODUCTION
This document contains the terms and conditions of use and legal information (from now on referred to as the "Terms and Conditions") applicable to the access and use of services offered by Alternativo Perú SAC, with RUC No. 20602341608 (from now on, "Peru Well Served" or "PWS").
Peru Well Served is a Peruvian company that offers tourist services focused on experiences that promote the discovery of local gastronomy and culture, tailored to the requirements of each of its clients (from now on, the "Services").
Any person who contracts the Services assumes the role of Client (from now on, the "Client"), whether contracting the services as a group or individually as a "FIT" (Free Independent Traveler), committing to observe and strictly comply with the provisions included in these Terms and Conditions.
Peru Well Served informs each Client that, in case of disagreement with the content of the Terms and Conditions, they should refrain from accessing and/or contracting the Services.
Therefore, by contracting the Services, the Client expressly declares to have read the Terms and Conditions and to know and fully understand them, accepting them in all their aspects.
01. Quotation and Contracting of Services
For a Client to contract the Services, they must submit a request through the following channels of Peru Well Served:

Once Peru Well Served receives the request, it will prepare a travel proposal that includes an itinerary designed according to the Client's requirements (from now on, the "Itinerary") and a budget (from now on, the "Quotation").
The prices indicated in the Quotation, as well as the availability of the quoted services, are subject to changes until the moment of purchase confirmation by the Client. This confirmation is made by paying the initial deposit by the Client and providing the required personal information (including a photograph of the Clients' passports). Upon receiving this confirmation, PWS must re-confirm the prices and availability of the services with the providers, as they may have changed over the days. If some prices have changed, PWS will notify the Client of the updated Quotation.
All activities or services not expressly described in the Itinerary will have an additional cost. The Quotation does not include additional payments for tips, excess baggage, or any other activity or service not explicitly specified in the Itinerary.
In the case of Group Quotations:
Prices in the Quotation are usually based on accommodation in double rooms. If any participating Client in the group requires a single room or other type of accommodation, they must request it and pay the corresponding supplementary cost.
All quoted transfers are group transfers. If any participating Client in the group requires an individual transfer, they must request it, and this will have an additional cost.
Optional activities can be purchased up to 45 (forty-five) calendar days before the start of the trip. Between 44 (forty-four) and 15 (fifteen) calendar days before the trip, a surcharge of 10% (ten percent) will apply. In all cases, the contracting of optional activities is subject to confirmation of availability by the respective providers.
The Quotation for a group trip will be made considering a minimum and maximum number of passengers for the journey to take place, which will be indicated in the proposal. If these minimum quotas are not reached, PWS will refund the Clients the money received that has not been used to make advance payments to the providers and cannot be recovered. It should be noted that refunds to Clients are not always immediate; they are subject to the time providers take to process refunds to PWS, respectively.
If the minimum number of passengers is not reached, and if the Clients wish, PWS may provide a new Quotation based on the new number of travelers. If they accept the new Quotation, they can pay the difference and proceed with the trip.
Tips are never included in the Quotation and should preferably be given in cash at the destination. Although tips are optional, the recommended amount is between USD 10.00 (ten dollars) and USD 12.00 (twelve dollars) per person daily. This amount is usually collected at the beginning of the trip and distributed during the journey to guides, drivers, servers, etc., as appropriate.
02. Reservation and Payment of Services
Once the Quotation for the Services is confirmed, Peru Well Served will issue an electronic ticket or invoice to the Client for the total amount to be paid for the Services (from now on, the "Price").
a) For reservations made more than 45 days before the travel date: The Client must make an initial deposit of 40% (forty percent) of the total amount of the Quotation, which will be paid as a confirmation of the reservation. PWS will use this deposit to guarantee the availability of the quoted Services. The remaining 60% (sixty percent) can be divided into up to two (2) additional payments. The due dates for these installments will be defined in the Quotation and will depend on the travel date. 100% of the trip price must be paid by 45 (forty-five) calendar days before the arrival of the passengers.
b) For reservations made less than 45 days before the travel date: The Client must pay the total price of the Quotation at the time of confirmation.
In the case of group trips, 100% of the trip price must be paid by 62 (sixty-two) calendar days before the arrival of the passengers.
Once the payments are made, the Client must send Peru Well Served the proof confirming the transaction, at which point Peru Well Served will proceed to manage the hiring of the Providers involved in the provision of the Services.
If the Client does not pay the price according to the deadlines specified in this section and/or those indicated in the Quotation, Peru Well Served cannot guarantee the availability of the Services or the agreed-upon price. It will have the full authority to release the block on rooms, transportation, trains, or flights contracted (in the case of groups) and the right to retain any amount the Client has deposited.
Only after receiving written confirmation from the Providers Peru Well Served can fully confirm specific details of the Itinerary, including but not limited to flight schedules, ground transportation, maritime transportation, hotel accommodations, restaurant reservations, gastronomic experiences, tourist excursions, etc.
Once confirmation is received from the Providers, Peru Well Served will proceed to confirm the remaining details outlined in the Service proposal.
The Client accepts and declares knowledge that the Services offered by Peru Well Served are sold as a package, and they cannot demand the breakdown of prices for activities independently.
In case any of the activities involved in the provision of the Services are not available, the Client accepts and consents that Peru Well Served may propose other similar alternatives.
To ensure the availability of the contracted services, the Client must provide Peru Well Served with the requested documentation according to the deadlines indicated in the proposal. This information includes, but is not limited to, passport copies, allergies and intolerances, preferred accommodation type, and information on international and/or domestic flights purchased directly by the Client, among others. Any delay in delivering this information or documentation, inaccuracies, or errors in it will not be the responsibility of Peru Well Served.
03. Payment Methods
The Client can make the total or partial payment of the Quotation through the following methods:

• Cards, as long as they are VISA, American Express, MasterCard, and/or Diners Club. In this case, we will send a payment link to the client via email, indicating the amount to be paid.
04. Providers
The Client accepts and declares knowledge that Peru Well Served is a tourism agency and acts as an intermediary between the Service providers and the Clients. As such, it is expressly established that Peru Well Served may outsource and/or subcontract services offered by other companies (the Providers) to fulfill the Itinerary that involves the provision of Services. The Providers involved in the provision of Services may include, among others:
Airlines
Hotels
Ground Transportation Companies
Tour Operators
Restaurants
Chefs
Tour Guides
05. Changes and Modifications to Services
Changes requested by the Client:
If the Client requests modifications to their travel itinerary after the first payment has been made and PWS has confirmed the services, the Client must cover the additional costs that may arise from the requested changes. PWS will manage the requested changes, but they are subject to availability.
If the client makes modifications to the Itinerary on their own and without notifying PWS in advance, the company will not be responsible for any additional costs that may arise from such changes.
If the client wishes to make changes during the trip, these must be requested with a minimum of 48 (forty-eight) hours' notice. PWS will manage the requested changes, but they are subject to availability and additional costs that must be covered by the Client.
Changes in the itinerary due to force majeure:
PWS may assist in managing a solution but will not be responsible for covering the expenses or additional costs that may arise from changes in the itinerary due to force majeure, such as social and/or political disturbances, strikes, road closures, weather, changes/cancellations in flight schedules, unexpected illness or discomfort of the Client, and, in general, any extraordinary phenomenon beyond the control of PWS.
In such circumstances, PWS will try its best to offer the client alternative solutions, reschedule services, and/or propose experiences of equivalent quality. However, if that is not possible or the Client does not wish to accept the proposed alternatives, PWS is not obligated to refund the amount paid by the Client for activities and services not performed.
If any of the Providers contracted by Peru Well Served for the provision of Services make any changes that affect the Itinerary – minor or significant - and notify PWS, the company will inform the Client as soon as possible.
06. Cancellation of Services:
If the Client wishes to cancel the Services, including travel reservations and corresponding spaces, the Client must immediately notify Peru Well Served through an email communication addressed to contact@peruwellserved.com or sales@peruwellserved.com or ventas@peruwellserved.com
If the Client sends the communication described in the preceding paragraph, Peru Well Served will assess the timing of the cancellation notice. Depending on the cancellation date and the trip's start date, the following amounts will be refunded:
For Individual Travelers or FITs (Free Independent Travelers):
Cancellations up to 45 calendar days before the departure date:
A 10% (ten percent) charge of the total quoted amount for administrative expenses will apply.
Services such as flights, Machu Picchu tickets, Inca Trail, and restaurants may be non-refundable and subject to the conditions of airlines and institutions.
The initial deposit, minus the abovementioned charges and services, will be refundable.
Cancellations within 45 calendar days before the trip:
The initial deposit will not be refundable. This amount will be used to cover services - such as flights, Machu Picchu tickets, Inca Trail, and restaurants - that are usually non-refundable and subject to the conditions of airlines and institutions.
A 5% (five percent) charge of the total quoted amount for administrative expenses will apply.
Payments beyond the initial deposit and the administrative fee will only be refunded depending on the flexibilities offered by the Providers. We will make a reasonable faith effort to recover the maximum amount possible and refund it to our clients, but we cannot provide any specific guarantee. Airlines tend to have stricter refund policies, and we cannot guarantee any refund or credit note.
All refunds from PWS, if applicable, will be issued within 30 (thirty) business days following the cancellation request. PWS will not be responsible for refund delays from any of the Providers. However, the company commits to making its best effort to recover the money paid by clients in the shortest time possible. The method of refund will depend on the payment platform the Client uses. The Client accepts and declares that they must bear any expenses incurred by Peru Well Served to process any refund, if applicable.
For groups:
From the deposit payment date until 61 (sixty-one) calendar days before the trip's start, the Client will receive an 80% (eighty percent) refund of any payment made.
Passenger name changes will be accepted free of charge up to 60 (sixty) calendar days before the trip. After this date, name changes will be subject to a fee.
Between 60 (sixty) and 31 (thirty-one) calendar days before the trip's start date, the Client will receive a maximum refund of 50% (fifty percent) of the total quoted price. Services such as flights, Machu Picchu tickets, Inca Trail, and restaurants may not be refundable and are subject to the conditions of airlines and institutions. If the Client has only paid the initial deposit, it will not be refunded.
There will be no refunds for cancellations within 30 (thirty) calendar days before the trip starts.
Optional activities:
Up to 31 calendar days before the trip starts, the Client may cancel optional activities and receive a 100% refund, provided such activities do not include any flights or entrance tickets to tourist sites. If applicable, the refund for such services will be subject to the service providers’ policies.
No refunds will be issued for canceling an optional activity less than 30 (thirty) calendar days before the trip's start.
Optional activities may have specific cancellation policies mentioned in the Quotation and travel proposal.
All refunds, if applicable, will be issued through the WeTravel platform within 30 (thirty) business days following the cancellation.
Peru Well Served reserves the right to cancel the reservations involved in the Services under circumstances where it is compelled to do so for reasons beyond its control. In such circumstances, Peru Well Served will try to find and offer the Client other reservations at the same price. However, if this is not possible or the Client does not wish to accept the alternatives proposed by Peru Well Served, the company will refund the total amount deposited for the Service payment.
The preceding paragraph refers to all situations that may significantly alter the Itinerary involving providing Services. This includes but is not limited to, the unexpected change of tickets by contracted airlines, the impossibility of visiting a tourist destination due to weather conditions, and the cancellation of gastronomic experiences by contracted restaurants.
07. Reduction of Passengers:
Each Quotation is designed for the specific number of passengers the Client indicates. If the Client requests to reduce the number of passengers before or after any payments, PWS must requote the Services and present a new Quotation based on the new number of passengers. If there is a difference in the Quotation, the Client must pay this amount for their new reservation to be reconfirmed.
08. About Flights:
Most national and international air tickets are non-refundable, but it depends on the fare type and conditions the airline imposes. If the Client requests a modification, cancellation, change of date, or route change, they will be solely responsible for paying the penalties imposed by the contracted airline.
It is the Client’s responsibility to arrive at the airport on time for their flights. If the Client misses any of their flights while at the airport, PWS cannot be blamed for such an economic loss.
PWS will not be responsible for any expenses or additional costs that may arise from cancellations or airline flight schedule changes, as this is beyond PWS's control.
09. No-show:
Under no circumstances will Peru Well Served be obligated to refund the Client any amount related to activities or services that were not voluntarily used or used due to reasons attributable to the Client, such as delays or the inability to enter the country due to visa errors, for example.
10. Details of Services:
Peru Well Served will address the Client’s doubts, inquiries, and calls at any time during the provision of the Services, for which the Client must contact the emergency phones provided with the delivery of travel documentation.
The Client acknowledges that the "check-in" at hotels generally begins around 15:00 hours, and "check-out" is around 10:00 hours. However, it is the Client’s responsibility to confirm the exact conditions applicable to each of their accommodations.
Regarding air, train, and boat tickets, 100% (one hundred percent) payment is required in advance to issue the respective tickets and/or manage the corresponding reservations. Rates are subject to change until the final issuance of tickets.
Peru Well Served will need the Client's passports to carry out all the procedures involved in providing the Services. The Client commits to delivering their passports immediately after Peru Well Served requests them.
The Services include a host and/or tour guide who will accompany the Client during their stay in Peru, addressing their requirements and needs.
The Client accepts and declares knowledge that the host and/or guide will be authorized to immediately suspend their duties when:
The Client involves them in any situation that goes against the laws of the Republic of Peru, such as the acquisition of illicit substances, human trafficking, sex tourism, scams, theft, and, in general, any illegal activities. The host and/or guide will immediately inform the competent authorities when any of the situations above occur.
The Client poses a threat to the physical and psychological integrity of the host and/or guide, or if the Client threatens them.
The Client poses a danger to the host and/or guide and to any third party, in which case they will also immediately inform the competent authorities.
11. Health and Gastronomic Experiences:
During the provision of Services, Peru Well Served ensures to take its Clients to restaurants where services are of the highest quality, both in attention and care, and in food preparation.
Peru Well Served is not responsible for adverse reactions or discomfort that the Client may suffer due to food intake, especially regarding allergies, sensitivities, or other pre-existing conditions.
It is the responsibility of the Client to communicate in advance to PWS if they have any allergies, intolerances, dietary restrictions, medical conditions, or any other condition that may prevent the reactions and discomfort indicated in the previous paragraph, ideally during the brief and design process of the proposal.
PWS will not be responsible for accidents and/or adverse situations that may arise during activities or services.
Finally, the Client accepts and declares knowledge that there are restaurants that must be booked well in advance, for which they commit to complying with an advance deposit if necessary to secure the respective reservations and fulfill the Itinerary.
12. Travel Insurance:
The Client is solely responsible for the custody of their luggage and documentation, so Peru Well Served will not be responsible for the loss, theft, and/or deterioration of the luggage and/or documentation of the Client.
Therefore, Peru Well Served recommends that the Client take out travel insurance during the provision of Services.
Also, if the Client does not have international medical insurance, Peru Well Served recommends that it be contracted before the provision of Services.
If the Client requests it, Peru Well Served may assist them in contracting an insurance service that suits their needs.
13. Entry Requirements to Peru and Other Responsibilities of the Client:
The Client undertakes to have a valid passport with at least six (6) months of validity counted from the return date of the trip and with at least three (3) blank pages to allow for visas, entry and exit stamps, etc.
It is the responsibility of the Client to be up to date with their visas, health documents, vaccines, and necessary insurance to enter Peru.
Peru Well Served will not be responsible in any case for the failures or non-compliance that the Client may incur while obtaining the documents above or any other entry requirement to Peru by current regulations. If the Client does not have the required permits and cannot travel, it will be considered a No-Show, and no refund will apply to the contracted Services.
The Client accepts and declares knowledge that Peru Well Served is not obligated to inform them of the requirements to enter Peru, as the Services do not have the nature nor include immigration advice. Any information provided by PWS regarding visas, vaccines, climate, recommended clothing, etc., will be given in good faith but without any responsibility on the company’s part.
The Client undertakes to carry with them at all times the documentation provided by Peru Well Served that is essential for the proper provision of the Services. Documentation includes but is not limited to, personal documents, accommodation and service confirmations, tickets, airplane tickets, train tickets, or other means of transport, and, in general, any essential document for the proper execution of the Services.
The Client undertakes and is solely responsible for arriving on time at the departure locations indicated in the Itinerary, so Peru Well Served will not be responsible for any loss, damage, or event caused by the breach of this obligation.
14. Client and Peru Well Served Responsibility:
It is the Client's responsibility to provide Peru Well Served with the information it requests on time, according to the maximum deadlines established in the travel proposal. This information includes, but is not limited to, passport copies, allergies and intolerances, preferred accommodation type, and information on international and/or national flights purchased directly by the Client, among others.
If the Client fails to submit this information timely, Peru Well Served will not be able to purchase tickets or reserve some of the services that may be included in the Services. In case of not complying with the deadlines, the contracted services will be subject to availability, without the possibility of claiming or any refund if availability is no longer present.
The Client declares and accepts that they are responsible for all kinds of losses and damages, including but not limited to any consequential damage or loss of profits, that may be caused during the provision of Services to other Clients, Providers, and, in general, any third party.
Consequently, the Client will indemnify Peru Well Served, its directors, employees, and shareholders regarding any claim, complaint, report, legal or extrajudicial action (including, but not limited to preventive measures), or investigation before any jurisdiction, whether civil, criminal, administrative, regulatory, or arbitration, that may be filed by any Administrative Authority or by any person in case the Client is in any of the situations described in the previous paragraph.
Likewise, the Client is obliged to assume the costs and expenses required by the respective lawsuits, claims, reports, processes, measures, and investigations, including the fees of professional lawyers.
Consequently, the Client must assume the costs, expenses, and damages described or, as the case may be, reimburse immediately the amounts assumed by Peru Well Served for such concepts.
Likewise, within the scope of the Services, Clients declare to be aware of and accept that Peru Well Served is not engaged in the provision of any of the services provided by the Providers. Therefore, the Client waives any claim against Peru Well Served, its directors, employees, and shareholders regarding the services the Providers offer as part of the Itinerary.
Notwithstanding the preceding, the Client declares and accepts that Peru Well Served will not be responsible in any case for damages that the Client may suffer if they voluntarily place themselves in risky situations. Similarly, the Client accepts and declares that Peru Well Served is not obligated to compensate any damage due to fortuitous events or force majeure, the determinant act of a third party, or the imprudence of the one who suffers it. Also, the Client accepts and declares to be aware that Peru Well Served will not be liable for the delayed, defective, or partial non-compliance of the Services due to fortuitous events or force majeure.
15. Privacy and Personal Data
Peru Well Served undertakes to treat the personal data provided by the Client confidentially and exclusively for the provision of the Services, with all legal guarantees and security imposed by Law No. 29733, Personal Data Protection Law, and its respective Regulation.
If the User wishes to exercise the rights contemplated in the Personal Data Protection Law and its respective Regulation, they must send an email to contact@peruwellserved.com.
Peru Well Served commits not to transfer, sell, or share the data with third parties without the Client’s prior, express, and written consent.
16. Integrity of the Terms and Conditions
These Terms and Conditions replace all previous or contemporaneous communications and/or agreements (oral, written, or electronic) between the Client and Peru Well Served. If any provision of these Terms and Conditions is invalid, the invalidity shall apply to the minimum extent necessary for the other stipulations to remain enforceable. If Peru Well Served or the Client does not exercise the rights and powers granted under the Terms and Conditions, it shall not be considered a waiver of their continuation and the other rights and powers established herein.
17. Assignment
The Terms and Conditions are personal and may not be assigned or transferred to third parties without the prior written consent of Peru Well Served.
Peru Well Served may assign, transfer, or delegate any of its rights and obligations without the Client’s prior consent, for which the Clients accept and authorize in advance a possible assignment of Peru Well Served's contractual position to any third party.
18. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by the applicable laws of the Republic of Peru. Any dispute arising from the Terms and Conditions, their existence, validity, interpretation, scope, or compliance shall be submitted to the jurisdiction of the courts and judges of Cercado de Lima.

If the Client does not pay the price according to the deadlines specified in this section and/or those indicated in the Quotation, Peru Well Served cannot guarantee the availability of the Services or the agreed-upon price. It will have the full authority to release the block on rooms, transportation, trains, or flights contracted (in the case of groups) and the right to retain any amount the Client has deposited.
Only after receiving written confirmation from the Providers Peru Well Served can fully confirm specific details of the Itinerary, including but not limited to flight schedules, ground transportation, maritime transportation, hotel accommodations, restaurant reservations, gastronomic experiences, tourist excursions, etc.
Once confirmation is received from the Providers, Peru Well Served will proceed to confirm the remaining details outlined in the Service proposal.
The Client accepts and declares knowledge that the Services offered by Peru Well Served are sold as a package, and they cannot demand the breakdown of prices for activities independently.
In case any of the activities involved in the provision of the Services are not available, the Client accepts and consents that Peru Well Served may propose other similar alternatives.
To ensure the availability of the contracted services, the Client must provide Peru Well Served with the requested documentation according to the deadlines indicated in the proposal. This information includes, but is not limited to, passport copies, allergies and intolerances, preferred accommodation type, and information on international and/or domestic flights purchased directly by the Client, among others. Any delay in delivering this information or documentation, inaccuracies, or errors in it will not be the responsibility of Peru Well Served.
3. Payment Methods
The Client can make the total or partial payment of the Quotation through the following methods:

4. Providers
The Client accepts and declares knowledge that Peru Well Served is a tourism agency and acts as an intermediary between the Service providers and the Clients. As such, it is expressly established that Peru Well Served may outsource and/or subcontract services offered by other companies (the Providers) to fulfill the Itinerary that involves the provision of Services. The Providers involved in the provision of Services may include, among others:
Airlines
Hotels
Ground Transportation Companies
Tour Operators
Restaurants
Chefs
Tour Guides
5. Changes and Modifications to Services
Changes requested by the Client: If the Client requests modifications to their travel itinerary after the first payment has been made and PWS has confirmed the services, the Client must cover the additional costs that may arise from the requested changes. PWS will manage the requested changes, but they are subject to availability.
If the client makes modifications to the Itinerary on their own and without notifying PWS in advance, the company will not be responsible for any additional costs that may arise from such changes.
If the client wishes to make changes during the trip, these must be requested with a minimum of 48 (forty-eight) hours' notice. PWS will manage the requested changes, but they are subject to availability and additional costs that must be covered by the Client.
Changes in the itinerary due to force majeure:
PWS may assist in managing a solution but will not be responsible for covering the expenses or additional costs that may arise from changes in the itinerary due to force majeure, such as social and/or political disturbances, strikes, road closures, weather, changes/cancellations in flight schedules, unexpected illness or discomfort of the Client, and, in general, any extraordinary phenomenon beyond the control of PWS.
In such circumstances, PWS will try its best to offer the client alternative solutions, reschedule services, and/or propose experiences of equivalent quality. However, if that is not possible or the Client does not wish to accept the proposed alternatives, PWS is not obligated to refund the amount paid by the Client for activities and services not performed.
If any of the Providers contracted by Peru Well Served for the provision of Services make any changes that affect the Itinerary – minor or significant - and notify PWS, the company will inform the Client as soon as possible.
6. Cancellation of Services
If the Client wishes to cancel the Services, including travel reservations and corresponding spaces, the Client must immediately notify Peru Well Served through an email communication addressed to contact@peruwellserved.com or sales@peruwellserved.com or ventas@peruwellserved.com
If the Client sends the communication described in the preceding paragraph, Peru Well Served will assess the timing of the cancellation notice. Depending on the cancellation date and the trip's start date, the following amounts will be refunded:
For Individual Travelers or FITs (Free Independent Travelers):
Cancellations up to 45 calendar days before the departure date:
A 10% (ten percent) charge of the total quoted amount for administrative expenses will apply.
Services such as flights, Machu Picchu tickets, Inca Trail, and restaurants may be non-refundable and subject to the conditions of airlines and institutions.
The initial deposit, minus the abovementioned charges and services, will be refundable.
Cancellations within 45 calendar days before the trip:
The initial deposit will not be refundable. This amount will be used to cover services - such as flights, Machu Picchu tickets, Inca Trail, and restaurants - that are usually non-refundable and subject to the conditions of airlines and institutions.
A 5% (five percent) charge of the total quoted amount for administrative expenses will apply.
Payments beyond the initial deposit and the administrative fee will only be refunded depending on the flexibilities offered by the Providers. We will make a reasonable faith effort to recover the maximum amount possible and refund it to our clients, but we cannot provide any specific guarantee. Airlines tend to have stricter refund policies, and we cannot guarantee any refund or credit note.
All refunds from PWS, if applicable, will be issued within 30 (thirty) business days following the cancellation request. PWS will not be responsible for refund delays from any of the Providers. However, the company commits to making its best effort to recover the money paid by clients in the shortest time possible. The method of refund will depend on the payment platform the Client uses. The Client accepts and declares that they must bear any expenses incurred by Peru Well Served to process any refund, if applicable.
For groups:
From the deposit payment date until 61 (sixty-one) calendar days before the trip's start, the Client will receive an 80% (eighty percent) refund of any payment made.
Passenger name changes will be accepted free of charge up to 60 (sixty) calendar days before the trip. After this date, name changes will be subject to a fee.
Between 60 (sixty) and 31 (thirty-one) calendar days before the trip's start date, the Client will receive a maximum refund of 50% (fifty percent) of the total quoted price. Services such as flights, Machu Picchu tickets, Inca Trail, and restaurants may not be refundable and are subject to the conditions of airlines and institutions. If the Client has only paid the initial deposit, it will not be refunded.
There will be no refunds for cancellations within 30 (thirty) calendar days before the trip starts.
Optional activities:
Up to 31 calendar days before the trip starts, the Client may cancel optional activities and receive a 100% refund, provided such activities do not include any flights or entrance tickets to tourist sites. If applicable, the refund for such services will be subject to the service providers’ policies.
No refunds will be issued for canceling an optional activity less than 30 (thirty) calendar days before the trip's start.
Optional activities may have specific cancellation policies mentioned in the Quotation and travel proposal.
All refunds, if applicable, will be issued through the WeTravel platform within 30 (thirty) business days following the cancellation.
Peru Well Served reserves the right to cancel the reservations involved in the Services under circumstances where it is compelled to do so for reasons beyond its control. In such circumstances, Peru Well Served will try to find and offer the Client other reservations at the same price. However, if this is not possible or the Client does not wish to accept the alternatives proposed by Peru Well Served, the company will refund the total amount deposited for the Service payment.
The preceding paragraph refers to all situations that may significantly alter the Itinerary involving providing Services. This includes but is not limited to, the unexpected change of tickets by contracted airlines, the impossibility of visiting a tourist destination due to weather conditions, and the cancellation of gastronomic experiences by contracted restaurants.
7. Reduction of Passengers
Each Quotation is designed for the specific number of passengers the Client indicates. If the Client requests to reduce the number of passengers before or after any payments, PWS must requote the Services and present a new Quotation based on the new number of passengers. If there is a difference in the Quotation, the Client must pay this amount for their new reservation to be reconfirmed.
8. About Flights
Most national and international air tickets are non-refundable, but it depends on the fare type and conditions the airline imposes. If the Client requests a modification, cancellation, change of date, or route change, they will be solely responsible for paying the penalties imposed by the contracted airline.
It is the Client’s responsibility to arrive at the airport on time for their flights. If the Client misses any of their flights while at the airport, PWS cannot be blamed for such an economic loss.
PWS will not be responsible for any expenses or additional costs that may arise from cancellations or airline flight schedule changes, as this is beyond PWS's control.
9. No-show
Under no circumstances will Peru Well Served be obligated to refund the Client any amount related to activities or services that were not voluntarily used or used due to reasons attributable to the Client, such as delays or the inability to enter the country due to visa errors, for example.
10. Details of Services
Peru Well Served will address the Client’s doubts, inquiries, and calls at any time during the provision of the Services, for which the Client must contact the emergency phones provided with the delivery of travel documentation.
The Client acknowledges that the "check-in" at hotels generally begins around 15:00 hours, and "check-out" is around 10:00 hours. However, it is the Client’s responsibility to confirm the exact conditions applicable to each of their accommodations.
Regarding air, train, and boat tickets, 100% (one hundred percent) payment is required in advance to issue the respective tickets and/or manage the corresponding reservations. Rates are subject to change until the final issuance of tickets.
Peru Well Served will need the Client's passports to carry out all the procedures involved in providing the Services. The Client commits to delivering their passports immediately after Peru Well Served requests them.
The Services include a host and/or tour guide who will accompany the Client during their stay in Peru, addressing their requirements and needs.
The Client accepts and declares knowledge that the host and/or guide will be authorized to immediately suspend their duties when:
The Client involves them in any situation that goes against the laws of the Republic of Peru, such as the acquisition of illicit substances, human trafficking, sex tourism, scams, theft, and, in general, any illegal activities. The host and/or guide will immediately inform the competent authorities when any of the situations above occur.
The Client poses a threat to the physical and psychological integrity of the host and/or guide, or if the Client threatens them.
The Client poses a danger to the host and/or guide and to any third party, in which case they will also immediately inform the competent authorities.
11. Health and Gastronomic Experiences
During the provision of Services, Peru Well Served ensures to take its Clients to restaurants where services are of the highest quality, both in attention and care, and in food preparation.
Peru Well Served is not responsible for adverse reactions or discomfort that the Client may suffer due to food intake, especially regarding allergies, sensitivities, or other pre-existing conditions.
It is the responsibility of the Client to communicate in advance to PWS if they have any allergies, intolerances, dietary restrictions, medical conditions, or any other condition that may prevent the reactions and discomfort indicated in the previous paragraph, ideally during the brief and design process of the proposal.
PWS will not be responsible for accidents and/or adverse situations that may arise during activities or services.
Finally, the Client accepts and declares knowledge that there are restaurants that must be booked well in advance, for which they commit to complying with an advance deposit if necessary to secure the respective reservations and fulfill the Itinerary.
12. Travel Insurance
The Client is solely responsible for the custody of their luggage and documentation, so Peru Well Served will not be responsible for the loss, theft, and/or deterioration of the luggage and/or documentation of the Client.
Therefore, Peru Well Served recommends that the Client take out travel insurance during the provision of Services.
Also, if the Client does not have international medical insurance, Peru Well Served recommends that it be contracted before the provision of Services.
If the Client requests it, Peru Well Served may assist them in contracting an insurance service that suits their needs.
13. Entry Requirements to Peru and Other Responsibilities of the Client
The Client undertakes to have a valid passport with at least six (6) months of validity counted from the return date of the trip and with at least three (3) blank pages to allow for visas, entry and exit stamps, etc.
It is the responsibility of the Client to be up to date with their visas, health documents, vaccines, and necessary insurance to enter Peru.
Peru Well Served will not be responsible in any case for the failures or non-compliance that the Client may incur while obtaining the documents above or any other entry requirement to Peru by current regulations. If the Client does not have the required permits and cannot travel, it will be considered a No-Show, and no refund will apply to the contracted Services.
The Client accepts and declares knowledge that Peru Well Served is not obligated to inform them of the requirements to enter Peru, as the Services do not have the nature nor include immigration advice. Any information provided by PWS regarding visas, vaccines, climate, recommended clothing, etc., will be given in good faith but without any responsibility on the company’s part.
The Client undertakes to carry with them at all times the documentation provided by Peru Well Served that is essential for the proper provision of the Services. Documentation includes but is not limited to, personal documents, accommodation and service confirmations, tickets, airplane tickets, train tickets, or other means of transport, and, in general, any essential document for the proper execution of the Services.
The Client undertakes and is solely responsible for arriving on time at the departure locations indicated in the Itinerary, so Peru Well Served will not be responsible for any loss, damage, or event caused by the breach of this obligation.
14. Client and Peru Well Served Responsibility
It is the Client's responsibility to provide Peru Well Served with the information it requests on time, according to the maximum deadlines established in the travel proposal. This information includes, but is not limited to, passport copies, allergies and intolerances, preferred accommodation type, and information on international and/or national flights purchased directly by the Client, among others.
If the Client fails to submit this information timely, Peru Well Served will not be able to purchase tickets or reserve some of the services that may be included in the Services. In case of not complying with the deadlines, the contracted services will be subject to availability, without the possibility of claiming or any refund if availability is no longer present.
The Client declares and accepts that they are responsible for all kinds of losses and damages, including but not limited to any consequential damage or loss of profits, that may be caused during the provision of Services to other Clients, Providers, and, in general, any third party.
Consequently, the Client will indemnify Peru Well Served, its directors, employees, and shareholders regarding any claim, complaint, report, legal or extrajudicial action (including, but not limited to preventive measures), or investigation before any jurisdiction, whether civil, criminal, administrative, regulatory, or arbitration, that may be filed by any Administrative Authority or by any person in case the Client is in any of the situations described in the previous paragraph.
Likewise, the Client is obliged to assume the costs and expenses required by the respective lawsuits, claims, reports, processes, measures, and investigations, including the fees of professional lawyers.
Consequently, the Client must assume the costs, expenses, and damages described or, as the case may be, reimburse immediately the amounts assumed by Peru Well Served for such concepts.
Likewise, within the scope of the Services, Clients declare to be aware of and accept that Peru Well Served is not engaged in the provision of any of the services provided by the Providers. Therefore, the Client waives any claim against Peru Well Served, its directors, employees, and shareholders regarding the services the Providers offer as part of the Itinerary.
Notwithstanding the preceding, the Client declares and accepts that Peru Well Served will not be responsible in any case for damages that the Client may suffer if they voluntarily place themselves in risky situations. Similarly, the Client accepts and declares that Peru Well Served is not obligated to compensate any damage due to fortuitous events or force majeure, the determinant act of a third party, or the imprudence of the one who suffers it. Also, the Client accepts and declares to be aware that Peru Well Served will not be liable for the delayed, defective, or partial non-compliance of the Services due to fortuitous events or force majeure.
15. Privacy and Personal Data
Peru Well Served undertakes to treat the personal data provided by the Client confidentially and exclusively for the provision of the Services, with all legal guarantees and security imposed by Law No. 29733, Personal Data Protection Law, and its respective Regulation.
If the User wishes to exercise the rights contemplated in the Personal Data Protection Law and its respective Regulation, they must send an email to contact@peruwellserved.com.
Peru Well Served commits not to transfer, sell, or share the data with third parties without the Client’s prior, express, and written consent.
16. Integrity of the Terms and Conditions
These Terms and Conditions replace all previous or contemporaneous communications and/or agreements (oral, written, or electronic) between the Client and Peru Well Served. If any provision of these Terms and Conditions is invalid, the invalidity shall apply to the minimum extent necessary for the other stipulations to remain enforceable. If Peru Well Served or the Client does not exercise the rights and powers granted under the Terms and Conditions, it shall not be considered a waiver of their continuation and the other rights and powers established herein.
17. Assignment
The Terms and Conditions are personal and may not be assigned or transferred to third parties without the prior written consent of Peru Well Served.
Peru Well Served may assign, transfer, or delegate any of its rights and obligations without the Client’s prior consent, for which the Clients accept and authorize in advance a possible assignment of Peru Well Served's contractual position to any third party.
18. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by the applicable laws of the Republic of Peru. Any dispute arising from the Terms and Conditions, their existence, validity, interpretation, scope, or compliance shall be submitted to the jurisdiction of the courts and judges of Cercado de Lima.
